Invasive neurotechnologies are a frequent subject of discussion in neuroethics. Technologies, like deep brain stimulation and implantable brain-computer interfaces, are thought to hold significant promise for human health and well-being, but they also raise important ethical questions about autonomy, safety, stigma, privacy, and agency, among others. The terms ‘invasive’ and ‘invasiveness’ are commonly applied to these and other neurotechnologies, yet the concept of invasiveness itself is rarely defined or delimited. Some have suggested that invasiveness may have multiple meanings – physical, (...) emotional, or lifestyle – and that confusion about how people use the terms may lead to harm, especially for users of invasive devices. It is uncertain if debates in neuroethics contribute to this confusion. To investigate this, we conducted a study of how the term ‘invasiveness’ is used in neuroethics. We found that neuroethicists almost always use ‘invasiveness’ to refer to the physical features of interventions, and rarely to refer to other senses of invasiveness. We also found that referencing invasiveness does not determine which ethical issues are prioritized for a given type of neurotechnology. Overall, this study affirms the importance of understanding the meaning and use of the concept of invasiveness in ethical discussion of neurotechnology while also suggesting the need for further work in the area and consideration for rethinking what forms of technology we consider to be invasive. Several bioethicists have recently discussed the complexity of defining human death, and considered in particular how our definition of death affects our understanding of the ethics of vital organ procurement. In this brief paper, we challenge the mainstream medical definition of human death—namely, that death is equivalent to total brain failure—and argue with Nair-Collins and Miller that integrated biological functions can continue even after total brain failure has occurred. We discuss the implications of Nair-Collins and Miller’s argument and (...) suggest that it may be necessary to look for alternative biological markers that reliably indicate the death of a human being. We reject the suggestion that we should abandon the dead-donor criteria for organ donation. Rather than weaken the ethical standards for vital organ procurement, it may be necessary to make them more demanding. The aim of this paper is not to justify the dead donor rule. Rather, we aim to explore the perspective of those who agree with critiques of the whole brain and cardiopulmonary definitions of death but yet disagree with the proposal that we should abandon the dead-donor rule. We will consider what those who want to retain the dead-donor rule must argue in light of Nair-Collins and Miller’s critique. (shrink)

The isolated mention of the existence of a powerful Jewish polity in the Horn of Africa by Jewish traveller Benjamin of Tudela in the twelfth century AD has generally been given such credence by the twentieth-century orientalistes that it is often considered the first mention of the people later to be known as Falasha. This short passage has indeed engendered a large amount of scholarly literature, which has partially obscured the wider historical and geographical context to which it refers (...) and in which it was produced. Beyond his formulation of the hypothesis of this Jewish polity, which, it will be argued, probably never existed, this article suggests that Benjamin's Jewish viewpoint has much more to tell us about the regional scene than has been recognized. First, analyzed as an itinerary, Benjamin's text sheds new light on the trading routes of the time. Second, the comparison of this text with other sources from the twelfth and thirteenth centuries provides new perspectives on the religious, political, and economic intricacies of the time, a context in which, it is suggested, Benjamin's confusion about the identity of the polity he describes makes sense. Finally, while it probably does not constitute a reflection on a political entity that existed in actual fact, Benjamin's narrative, with all its ambiguities, may be considered a rather faithful mirror of the social complexity of the communities near the Red Sea and the Horn of Africa, which are at the crossroads of several worlds. I count myself privileged to respond to Kenneth Collins and Jerry Walls recent book on Roman Catholicism. I live in Fort Worth, TX, and I am a member of Wedgwood Baptist Church, which is one of more than 40,000 churches that together comprise the Southern Baptist Convention. I mention this so readers will know that my comments come from a conservative Evangelical Protestant perspective, and my thinking stems from a tradition that is decidedly not Roman Catholic. Having said this, (...) I’m much more sympathetic to Roman Catholicism than a great many Evangelicals, including Collins and Walls. I offer my criticisms of Rome, but I ask that readers not interpret me as someone who denies that the Roman Catholic Church counts as a Christian institution. In an effort to show good faith on this front, allow me to offer some defenses of Roman Catholicism against what I take to be over the top criticisms from some Protestant Evangelicals. (shrink)

The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

This chapter offers a proceduralist argument against capital punishment. More specifically, it contends that the possibility of irrevocable mistakes precludes the just administration of the death penalty. At stake is a principle of political morality: legal institutions must strive to remedy their mistakes and to compensate those who suffer from wrongful sanctions. The incompatibility of remedy and execution is the crux of the irrevocability argument: because the wrongly executed cannot enjoy the morally required compensation, execution is impermissible. Along with defending (...) his key premises, Yost explains the complicated role that sentencing uncertainty plays in the argument. He concludes by noting some of the flaws in substantive consequentialist and retributivist justifications of capital punishment. (shrink)

Many if not most sperm donors in the early years of IVF donated under conditions of anonymity. There is, however, a growing awareness of the ethical cost of withholding identifying parental information from donor children. Today, anonymous donation is illegal in many jurisdictions, and some jurisdictions have gone as far as retrospectively invalidating contracts whereby donors were guaranteed anonymity. This article provides a critical evaluation of the ethics and legality of anonymous donation. We defend Australian and British legislation that has (...) outlawed donor anonymity, and we argue for the establishment of a central registry that provides donor children with the ability to easily and reliably access identifying information about their donor parents. By placing style first, Sells argues that we must turn our eyes and minds outward to the greater world. Emphasizing beauty over emotion and appreciation over feeling, he attempts to break the stranglehold of the self so as to reconstitute our proper place among the many things of the world.

Giubiliniet aloffer some helpful reflections on the conscientious provision of medical care and whether and in what circumstances professional associations ought to support the conscientious provision of abortion in circumstances where abortion is banned or heavily restricted. I have several reservations, however, about the argument developed in the article. First, the essay makes questionable use of the case of Savita Halappanavar to justify its central argument about conscientious provision. Second, there is an apparent inconsistency between this article and the authors’ (...) statements elsewhere about the conscientious refusal of care. Third, there are risks that attend to professional associations supporting practitioners who break the law, and yet Giubiliniet aldo not give sufficient attention to this. We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

The right temporo-parietal junction (rTPJ) has been associated with two apparently disparate functional roles: in attention and in social cognition. According to one account, the rTPJ initiates a “circuit-breaking” signal that interrupts ongoing attentional processes, effectively reorienting attention. It is argued this primary function of the rTPJ has been extended beyond attention, through a process of evolutionarily cooption, to play a role in social cognition. We propose an alternative account, according to which the capacity for social cognition depends on a (...) network which is both distinct from and in tension with brain areas involved in focused attention and target detection: the default mode network. Theory characterizing the rTPJ based on the area’s purported role in reorienting may be falsely guided by the co-occurrence of two distinct effects in contiguous regions: activation of the supramarginal gyrus (SMG), associated with its functional role in target detection; and the transient release, during spatial reorienting, of suppression of the angular gyrus (AG) associated with focused attention. Findings based on meta-analysis and resting functional connectivity are presented which support this alternative account. We find distinct regions, possessing anti-correlated patterns of resting connectivity, associated with social reasoning (AG) and target detection (SMG) at the rTPJ. The locus for reorienting was spatially intermediate between the AG and SMG and showed a pattern of connectivity with similarities to social reasoning and target detection seeds. These findings highlight a general methodological concern for brain imaging. Given evidence that certain tasks not only activate some areas but also suppress activity in other areas, it is suggested that researchers need to distinguish two distinct putative mechanisms, either of which may produce an increase in activity in a brain area: functional engagement in the task versus release of suppression. ABSTRACT:Organismal superposition holds that the same individual both is and is not an organism, as a consequence of organismal pluralism. When coupled with the assumption that death is the cessation of an organism, this entails that there is no unique answer as to whether brain death is biological death. This essay argues that concerns about organismal pluralism and superposition do not undermine a theory of biological death, nor entail any metaphysical indeterminacy about the biological vital status of a brain-dead individual.

In 1894, the British sociologist Benjamin Kidd published Social Evolution, an influential book that summarised and evaluated the prevailing social theories at the end of the nineteenth century: Karl Marx's socialism and Herbert Spencer's social Darwinism. Both of these conflicting theories were based on Darwinian evolutionary theory. In this book, Kidd discusses the immense changes that applied science has brought to the world and the interconnectedness of everyone. The book's ten chapters include discussions of the conditions of human progress, (...) the function of religious beliefs, and the organisation of the working classes. Kidd found flaws in both Karl Marx's and Herbert Spencer's vision of society's future and concluded that religion was essential for the evolution of society because it acts in the interest of generational group survival rather than individual competition. Social Evolution called for a comprehensive study of society because a new era in Western civilisation was beginning. (shrink)

Evidential Decision Theory and Causal Decision Theory are the leading contenders as theories of rational action, but both face counterexamples. We present some new counterexamples, including one in which the optimal action is causally dominated. We also present a novel decision theory, Functional Decision Theory, which simultaneously solves both sets of counterexamples. Instead of considering which physical action of theirs would give rise to the best outcomes, FDT agents consider which output of their decision function would give rise to the (...) best outcome. This theory relies on a notion of subjunctive dependence, where multiple implementations of the same mathematical function are considered to have identical results for logical rather than causal reasons. Taking these subjunctive dependencies into account allows FDT agents to outperform CDT and EDT agents in, for example, the presence of accurate predictors. (shrink)

Gadamer has written several powerful studies of Platonic dialectic. His emphasis on shared understanding, the fusing of horizons and other hermeneutic notions are partially drawn from a study of Plato’s elenctic dialogues. However, Socrates in Gorgias makes a claim about the imperative of self-refutation that not only complicates our understanding of Socratic method, but Gadamer’s reading of it as well. This article is meant to explore just how the imperative of self-refutation causes difficulty for Gadamer’s understanding of dialectic, especially his (...) distinction between authentic and inauthentic dialectic. After considering the nature of ‘refutation’, this article will examine whether Gadamer’s notions of shared understanding, the ‘facts of the matter’, and self-understanding help us to resolve this problem. It shall be concluded that the teacher must take any refutations of his/her own views seriously, but has no special obligation to refute (introspectively) any of their own views, even those beliefs, theories, principles or criteria that enable him to guide the argument. As a result of innovations, mainly new products and services, but also processes or new marketing methods, animal populations and species disappear. The massive development of technologies, products and consumer goods, both current and in the past, has a direct impact on the depletion of natural resources. Innovation is a dual‐entry device that can be called world‐innovation, on the one hand, and consequential‐innovation, on the other. In this chapter, the authors propose to review the change from a new perspective, more (...) precisely, with two major dimensions: world‐innovation and consequential innovation, which help us to understand why innovation has become what it is. Evidential Decision Theory is flawed, but its flaws are not fully understood. David Lewis (1981) famously charged that EDT recommends an irrational policy of managing the news and “commends the ostrich as rational”. Lewis was right, but the case he appealed to—Newcomb’s Problem—does not demonstrate his conclusion. Indeed, decision theories other than EDT, such as Committal Decision Theory and Functional Decision Theory, agree with EDT's verdicts in Newcomb’s Problem, but their flaws, whatever they may be, do not stem from any (...) ostrich-like recommendations. We offer a new case which shows that EDT mismanages the news, thus vindicating Lewis’s original charge. We argue that this case reveals a flaw in the “Why ain’cha rich?” defense of EDT. We argue further that this case is an advance on extant putative counterexamples to EDT. (shrink)

A prominent approach to scientific explanation and modeling claims that for a model to provide an explanation it must accurately represent at least some of the actual causes in the event's causal history. In this paper, I argue that many optimality explanations present a serious challenge to this causal approach. I contend that many optimality models provide highly idealized equilibrium explanations that do not accurately represent the causes of their target system. Furthermore, in many contexts, it is in virtue of (...) their independence of causes that optimality models are able to provide a better explanation than competing causal models. Consequently, our account of explanation and modeling must expand beyond the causal approach. (shrink)

Mais il est en passe de combler son retard grace en particulier a l'impulsion donnee depuis un demi-siecle aux recherches sur l'idealisme allemand. Le premier volume de cet ouvrage se propose de presenter le devenir de Schelling sous le signe du (...) systeme vivant. La derniere philosophie de Schelling est analysee dans le second tome. Elle est presque tout entiere posthume, a l'exception de la Preface a Cousin (1834) et de quelques autres textes brefs. La dualite philosophique, enseignee a Berlin, est l'ultime avatar de ce qui etait de facon latente une philosophie en deux. L'auteur s'attache ici a expliquer en detail les motifs et les problemes de cette dichotomie tardive, mais fondee. (shrink)

Many accounts of scientific modelling assume that models can be decomposed into the contributions made by their accurate and inaccurate parts. These accounts then argue that the inaccurate parts of the model can be justified by distorting only what is irrelevant. In this paper, I argue that this decompositional strategy requires three assumptions that are not typically met by our best scientific models. In response, I propose an alternative view in which idealized models are characterized as holistically distorted representations that (...) are justified by allowing for the application of various modelling techniques. This paper has two aims. The first is to present and defend a new argument for rights contributionism – the view that the notion of a moral claim-right is a contributory (or pro tanto) rather than overall normative notion. The argument is an inference to the best explanation: it is argued that (i) there are contributory moral factors that contrast with standard moral reasons by way of having a number of formal properties that are characteristic of rights, even though they (...) can be overridden, and (ii) that this is best explained by a view that takes these factors to correlate with rights. The second aim is to show that the truth of rights contributionism matters for normative ethics. More specifically, it is argued that rights contributionism clears the way for deontologists to justify the pre-theoretically plausible verdict that we have a duty to save the greater number in so-called Taurek scenarios – scenarios in which we have to choose between saving either a greater or a smaller number of different people. The chapter offers a novel and distinctively deontological explanation of this verdict that is based on the assumption that everyone has a pro tanto right to be saved in a Taurek scenario. (shrink)
